Surah Al-Baqarah, Ayat No 229

Translation:

Divorce is (revokable) 2 times (only). In that case, either hold (the wife) with respect (in wedded correlation) or free her with gentleness.

It is not legal for you to get back whatever thing of that which you have given them, unless both fear that (now by sustain wedded bind) they may not be able to examine the limits set by Allah.

Therefore, if you fear that both will be unable to maintain within Allah’s limits, in that case there shall be no offense upon any of them if the wife (herself) may sacrifice something as recompense to free herself (from this upsetting tie).

Note that these limits are set by Allah Almighty. So, do not go beyond them. And those who surpass the limits set by Allah; it is they who are the offenders.

Interpretation:

In this short verse, a great social evil has been corrected, which was prevalent in the Arab ignorance. The rule in Arabia was that a man was allowed to divorce his wife without reckoning.

He used to divorce the woman from whom her husband had gone badly, so that she could neither live with him nor be free from him and marry another man.

This verse of the Qur'an closes the door to this oppression. According to this verse, a man can exercise the right of reciprocal divorce on his wife only twice in a marriage relationship.

A man who has divorced his wife twice and returned to her, whenever he divorces her for the third time in his life, the woman will be permanently separated from him.

سورۃ البقرہ آیت نمبر 229

ترجمہ:

طلاق ( صرف ) 2 بار ( تک ) ہے، پھر یا تو (اہلیہ کو) احسن طریقے سے (اپنی زوجیت میں) روکنا ہے یا اچھائی کے ساتھ رخصت کرنا ہے، اور تمہارے لئےیہ جائز نہیں ہے کہ جو شے تم انہیں دے چکے ہو اس میں سے کچھ واپسی کا تقاضہ کرو ماسوائے اس کے کہ دونوں کوڈر ہو کہ (اب رشتۂ ازدواجیت قائم رکھتے ہوئے) دونوں (شوہر اوربیوی) اللہ کی قائم کی حدوں کو برقرار نہیں رکھ سکیں گے۔ سواگر تمہیں اندیشہ ہو کہ دونوں اللہ کی رکو قائم نہ رکھ سکیں گے، پھر (اندریں صورت) ان پر کوئی گناہ نہیں ہے کہ بیوی (خود) کچھ بدلہ دے کر (اس تکلیف دہ رشتےسے) چھٹکارہ پا لے، یہ تمام اللہ تعالیٰ کی (قائم کردہ) حدودہیں۔ سوتم ان حدودسےتجاوز مت کرواور جو لوگ اللہ کی حدود سےآگے بڑھتے ہیں تو ایسے ہی لوگوں کا شما ر ظالموں میں ہےo

تفسیر:

اس نہایت ہی مختصرسی آیتِ مبارکہ میں ایک بڑی معاشرتی خرابی کی طرف توجہ دلا کر اصلاح کی گئی ہے جو زمانہِ جاہلیت میں عرب کے معاشرےمیں رائج تھی ۔ عربوں میں یہ قانون تھا جس کے مطابق ایک آدمی کو اپنی بیوی کو ان گنت طلاق دینے کا اختیار تھا ۔

جِس عورت سے اس کا خاوند ناراض ہو جاتا ، وہ اس کو بار بار طلاق دے کر رُجوع کرتا رہتا تھا، تاکہ نہ تو وہ غریب عورت اُس کے ساتھ بس سکے اور نہ ہی اس شخص سے آزاد ہو کر کسی اور آدمی سے نکاح کر سکے ۔

قرآنِ مجید فرقانِ حمید کی یہ آیت صرف اِسی ظلم کا دروازہ بند کرتی ہے جو عرب معاشرے میں برپا تھا ۔ اس آیتِ مبارکہ کی رُو سے ایک آدمی ایک رشتہِ ازدواج میں اپنی منکوحہ پرزیادہ سے زیادہ دو بار ہی طلاقِ رجعی کا حق استعمال کر سکتا ہے۔

جوآدمی اپنی زوجہ کو دو بار طلاق دے کر اس سے دوبارہ رجوع کر چکا ہو، وہ شخص اپنی زندگی میں جب کبھی اسی عورت کو تیسری مرتبہ طلاق دے گا تو وہ عورت اس شخص سےمستقلاً علیحدہ ہو جائے گی ۔
